These Terms and Conditions ("Terms") govern your access to and use of the PackSmart AI mobile application ("Service"). The Service is owned and operated by PackSmart AI.

By installing or using the Service, you agree to be bound by these Terms.

1. Description of Service

PackSmart AI is a mobile tool for home organization and moving management. Key features include:

• Local Inventory Cataloging: Organizing items by Home, Room, and Container.
• AI Image Recognition: Utilizing AI to identify items from photos.
• Label Generation: Creating printable labels and QR codes for physical containers.

2. Local Data Storage & Privacy

2.1 Local-First Architecture

Unlike cloud-based apps, PackSmart AI stores all your inventory data, photos, and metadata locally on your device. We do not host your personal inventory on our servers.

2.2 Data Loss Risk

Because your data is stored locally:

• If you delete the app or lose/damage your device, your data will be permanently lost.
• PackSmart AI cannot recover deleted data for you, as we do not have access to it.

2.3 User-Initiated Backups

The Service may provide an option to back up your data to third-party cloud providers (e.g., Google Drive, iCloud, Dropbox).

• Backups are optional and require your explicit consent.
• We are not responsible for the security, availability, or technical failures of these third-party storage providers.

3. AI Image Recognition

3.1 Processing vs. Storage

When you use the "Add Items via AI" feature:

• Your images are transmitted to a secure third-party AI service (e.g., OpenAI, Google Vision) for the sole purpose of identifying objects.
• Once the identification is complete, the resulting data is sent back to your device and stored locally.

3.2 Accuracy Disclaimer

AI is not 100% accurate. The item lists generated by PackSmart AI are "drafts" based on computer vision.

• You are solely responsible for reviewing and editing the AI-generated content.
• We are not liable for any discrepancies, misidentified items, or omissions in your inventory.

4. User Responsibilities

You represent and warrant that you will use PackSmart AI only for lawful purposes. You agree not to:

• Attempt to reverse-engineer the AI recognition workflows.
• Use the app to catalogue illegal, hazardous, or prohibited materials.
• Use the app in any way that violates the privacy or intellectual property rights of others.

5. Limitation of Liability

To the maximum extent permitted by law, PackSmart AI and its officers shall not be liable for:

• Physical Loss: Any loss, theft, or damage to your physical belongings during a move or while using the app.
• Data Loss: Loss of inventory data due to app deletion, hardware failure, or lack of backups.
• Inaccuracy: Any reliance on AI-generated lists or QR codes that results in misplaced items.
• Direct/Indirect Damages: Any incidental or consequential damages exceeding the amount you paid (if any) to use the app.

6. Intellectual Property

PackSmart AI, including its interface, code, and logo, is the intellectual property of PackSmart AI. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

7. Termination

We reserve the right to discontinue or modify the Service at any time. Because your data is stored locally, you may continue to use the app on your device as-is, but we do not guarantee future updates or compatibility with new OS versions.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state/country the application is being used in without regard to its conflict of law provisions.
